drug abuse

why is it that drug addicts get methadone in scotland free and some get pip but people who are generally disabled dont its all wrong

Hi,

I can't answer the methadone question because this is a benefits forum, sorry.

As for PIP not everyone qualifies because of those descriptors. You have to prove they apply to you. Sending proof with a claim for helps. If not successful after the assessment the Mandatory Reconsideration first followed by the Tribunal. 70% of those who appear at their Tribunal win.

Also remember we only ever hear the bad stories. Those that have a decision in their favour have no questions to ask, therefore we just don't hear their story. Lots of people are successful.

Exactly how I feel makes me so mad!!! I know people who do that and more seems to me the worse u are in this world the better u get looked after by our government

hi denise i was awarded pip in 2013 8 points for daily living 10 for mobility [i had good medical evidence from consultants and got treated like a pow in the war at tribunal my condition hasnt changed.and they still refused me

well said mandie

Are you saying you have just lost your PIP appeal and you put in lots of good medical evidence

Hi Brian,

Did you have a review and were refused, then took it Tribunal and still lost? If so when did your hearing for the Tribunal take place? Did you appear in person?

@brian32790 I had lovely brown letter in post today lost my appeal so taking it to Tribunal going to take it all the way got my Local MP on my case as well. The woman who took my assessment told nothing but lies makes me so mad people telling lies said cause I went there dressed ok and made eye contact I'm fine. Come live my life for week!! If I went dresses like I don't know what and didn't look her in eye probably would've got it. also makes me mad Brian like you said all these on drugs get it and they do as I know so many people that do it and even the cars to go with it

I completely agree with you, it is wrong but what can one do?

Sarah

hi denise i had a review and they refused me ,i then went to the tribunal in person ,i had lots of medical evidence to back my claim my condition started in 2013,nothing has changed ,i mean hasnt got worse or better, doctor just stated raising his voice i was ready to ask for a postponement but thought ive waited long enough ,grin and bare it i think the system is still a sham

Hi,

I'm sorry to hear that you were in that 30% of those who lose their Tribunal. That figure is actually quite low. As you most likely know by now the only way you can take it to the Upper Tribunal is if an error in law was made in making the decision. To know for sure then you will need to write to the Tribunal and ask them to send you the Statement Of reasons (SOR) and you have 1 month to do this. Once you have that then you need to find someone that specialises is finding errors in law. Not an easy thing to do and quite rare to find those.

If no errors in law were made then you can re-apply at anytime. If you re-apply i'd advice you to get some help with filling that form in.

Whilst there are lots of bad negative stories out there, there's also lots of people that do have a decision in their favour but we don't hear their story because they have to questions to ask if they are happy with their award.
