In terms of Herpes, there is a large percentage of many populations that are carriers of the virus anyway, even before they become sexually active, or obviously they can get the virus from any carrier through oral or unprotected penetrative sex. The spots you have however, may not actually be herpes, as they would normally blister and burst and emit a clear fluid, and, you would likely have pain when urinating. In addition to the spots you have a common skin condition whereby you have skin at the side of your penis that is attached to the head and shaft of your penis. This can easily be resolved should you choose to do anything about it.
So, with what you have happening right now the best approach would be to go see a Urologist, you can access these directly from a Sexual Health Service, or a GUM Clinic at a General Hospital if you are in the UK, otherwise you can get a referral from your Regular / Family Doctor / GP …
